More Than Metadata or Error-Level Analysis
Rich does not rely solely on metadata or error-level analysis (ELA). Such techniques can provide useful information, but they can also fail to detect manipulation or be easily misinterpreted. Most so-called forensics experts have a certificate from a photo forensics software company, earned after only a few hours of remote training. Most have no professional photography experience or much, if any, experience with digital retouching.

When a Photo May Be Misleading
Many photos are misleading even without being manipulated.
Rich can analyze whether characteristics such as perspective, lens distortion, lighting, shadows, color, exposure, composition, or photographic techniques could cause an image to create a false or misleading impression.
In some cases, he can calculate the sun’s relative position for a particular time, date, and location and compare it with the shadows and illumination visible in a photograph. This can sometimes help determine whether an outdoor photograph could have been taken when and where a witness claims.
Recent Cases Involving A.I.
In October 2025, Rich analyzed a photographic exhibit involving a mastectomy site in a medical malpractice case against a surgical team and hospital. His forensic analysis showed the image was created using a combination of A.I. and Photoshop. The photo was not even of the plaintiff. AI completely fabricated the portion of the image showing the surgical site. After his examination and a four-hour deposition, the plaintiff’s attorney filed an emergency motion to withdraw from the case.
This year, he worked on another case where image analysis proved that A.I. fabricated false evidence by adding an A.I.-generated object to a genuine photo. A motion to dismiss the case was made and granted.
Experience
Rich has been a full-time, self-employed commercial photographer for more than 40 years. His clients have included numerous multinational corporations, and his commercial photography has received international recognition.
His extensive experience creating and manipulating professional images gives him a perspective that goes beyond simply examining a file with automated forensic software.
He has provided forensic reports for international clients, including the Kingdom of Saudi Arabia, and has testified as an expert witness in U.S. federal court. In a trademark infringement case brought by a large corporation against a small business, Rich prepared more than 50 exhibits showing how evidence was falsified to bolster the corporation’s case. It was a David-and-Goliath story: two attorneys working from home against a five-billion-dollar corporation backed by a nationally recognized law firm with 2,200 attorneys. A motion for sanctions was made and awarded. The case was dismissed with prejudice. An article mentioning Rich’s part in the case was published in “The American Lawyer.”
